The renovation work on my apartment building is proceeding apace. Today was my day to get a new bathroom faucet and a new main stop valve. First they turned off the water to my unit, then they disconnected the old fittings, then they turned the water back on.

Does the procedure I've just described seem to be missing a logical step?


 



 


They took some big vacuum cleaners to suck up the water, then turned them on their "blower" setting to dry my floor off. Fortunately I thought quickly enough to get all my satchels containing my important paperwork, and Mat's paintings, and my law degree and license to practice, so nothing appears to have been damaged.

Glad it's all over.

Actually, even as the water was still flowing from my apartment out into the hallway, I was going through the whole rigamarole about how the case sounds in negligence rather than contract, which means I can sue the plumbing contractors directly rather than having to sue my landlord and have them implead the plumbing contractors in turn. In other words, lack of privity of contract is a defense not available to them in this case. The problem is how deep are their pockets? It could merely be a shell corporation without assets or capitalization. In any case, res ipsa loquitur clearly obtains here, as the plumbing system was clearly a hazard under their momentarily exclusive control from which the damaging agent escaped through their failure properly to contain.

The problem is I reacted quickly enough both in phoning building management and in getting my valuables and my electronics and electrical cords out of harm's way that I've yet to discover any actual damages.

But I'll keep on looking!
